Electricity Market Surveillance
The OEB is responsible for monitoring how well the electricity market is working. As part of this market surveillance role, the Board may issue reports to the Minister on the efficiency, fairness, transparency and competitiveness of the market as well as reporting on any abuse or potential abuse of market power where requested to do so by the Minister of Energy.

The legislation changes the Board’s responsibilities in electricity market surveillance. In particular, the Board assumes responsibility for the Market Surveillance Panel from the Independent Electricity System Operator (IESO).
Bylaw #3
On January 17, 2005, the Board's Management Committee made By-law #3 following a public consultation. By-law #3 relates to the composition and functions of the Market Surveillance Panel and the appointment, removal and remuneration of its members, and was most recently amended by By-law #5.
The Board and the IESO have entered into a Protocol under which the IESO, through its market assessment unit, will continue to assist the Market Surveillance Panel now that it has become a Panel of the Board. The Protocol, which was contemplated in the Board’s By-law #3, also provides for the Market Surveillance Panel to continue to assist and advise the IESO on various matters arising under the market rules and addresses issues relating to confidentiality and the exchange of information. The Protocol came into effect on April 25, 2005 for a period of one year, and has been renewed for two successive two-year periods to April 25, 2010.
